By accessing or using the Site or by using the Service on the Site you agree to be bound by these terms and conditions set forth below including any additional guidelines and future modifications. When you access any sub-site, webpage, a hyperlink (whether belonging to an ‘associate’ of TripNight or otherwise) through this site, then such subsite may have its own terms and conditions of use which is specific to such subsite, webpage, hyperlink. The Terms and Conditions is a legal contract between you being, an individual customer, user, or beneficiary of this service, and Tripnight Tech Labs Private Limited.
TripNight acts as an “Intermediary” solely to assist customers in gathering travel information, determining the availability of travel-related products and services, making legitimate reservations or otherwise transacting business with travel suppliers, and for facilitating travel requirements. You acknowledge that TripNight merely provides intermediary services in order to facilitate services to you. TripNight is not the last mile service provider to you and therefore TripNight shall not be deemed to be responsible for any lack or deficiency of services provided by any person or entity including airline, hotel, activity provider or similar agency), you shall engage, hire from the content available on the Site.
TripNight may change, alter or remove any part of these below-written Terms and Conditions without any prior notice. Any changes done in this Terms and Conditions of Use will be applicable the moment they are posted on the site. You need to re-check the “Terms & Conditions” link to be fully aware of the entire scenario.
1. Agreement between the Clients & TripNight:
While accessing, using, browsing or make a booking through tripnight.com, users have to accept that they are agreed to the terms and conditions of our portal. In case of any violation, Tripnight Tech Labs Private Limited reserve all the rights for taking any legal actions against them.
2. Use of the Website
In case of your use of this website, you agree that:

You will use this Website to make only legitimate reservations for you or for another person for whom you are legally authorized to act.
You will inform such other persons about the Terms of Use that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto.
You will provide your proper and accurate Name (as per Passport or any other official ID), Address, Email ID, Cell Number.
You will be solely responsible for the Information provided and in case of any error or mistake in the provision of information.
TripNight will not be liable for the same all information supplied by you on this Website is true, accurate, current and complete, if you have an online account with this Website, you will safeguard your login details – login ID and password and will supervise the same.
You will be completely responsible for any use or misuse of your account by you and anyone other people other than you.
3. Prices on the Website:
The price, which we offer on TripNight.com, generally include accommodation charges, taxes (unless specified otherwise) and in special cases some meals (Breakfast /Lunch / Dinner). It never comprises any personal expense or other additional charges like telephone calls, personal-man services, entrance fees of any monuments and bar charges, etc.
4. Mode of Payments & the Policies:
To take advantage of any travel facility or services through TripNight.com, you have to give some part of your payment in advance. It gives you the confirmation of the booking. The advance amount to pay will be shared with you via any digital medium, including emails. The amount may also depend on the kinds of services, you are going to avail.
To make the payments online, you can use Visa, Master and American Express Cards. TripNight.com offers a safe transaction process and ensures you that your personal security codes will not be revealed in worst cases also.
For national/international advance payments, you can use Bank / Wire Transfer and transfer amount into our bank account together with the additional charges levied by the banks.
5. Communication Policy of the Site
Upon transacting on the Site, you will receive an e-mail from TripNight informing the status of your transaction. The e-mail will be sent to the e-mail address provided by you and TripNight is not responsible towards the receipt of the said e-mail in your inbox. You will have to take due care and caution. You are responsible for entering the proper and accurate contact details including your name (as per Passport), email ID to ensure that we can effectively communicate with you.
The customer acknowledges that the SMS (Short Messaging Service) provided by TripNight is an additional facility provided for the customer’s convenience. It is not mandatory under the law in force to provide SMS service alerts to the customers. In case you do not receive any SMS for whatsoever reason, TripNight is not liable for the same.
TripNight is not responsible to provide information on any change in flight schedules, cancellation, the status of airline/hotel etc.
Any grievance regarding the service should be communicated as per the grievance policy laid out herein.
6. Cancellation Policy
For cancellations done prior to the 30 days or more of the date of departure, initial deposit amount or 25% of the tour cost (if fully paid) will be charged as cancellation charges.
For cancellations done between 29 days to 15 days prior to the date of departure, 50% of the tour cost will be charged as cancellation charges.
For cancellations done between 14 days to 8 days of the tour, 75% of the tour cost will be charged as cancellation charges.
For cancellations done within 8 days of the tour, 100% cancellation charges will apply and you will receive no refunds.
7. Refund Policy
TripNight will process the refund only after getting cancellation request/claim from the customer/travel agent/corporate company through email or website after logging in.
Refund against the cancellation of air tickets will be credited directly in customers mode of payment after receiving the refund amount from the Airlines.
TripNight will process the refund within 72 hours only after receiving it from the concerned Airlines/hotel/transporter/other suppliers.
Due to Banking Procedures, Refund in credit cards may take a duration of 72 hours while it may take 7 days in case of net banking transactions.
8. Copyright & Trademark
All materials on this Site, including but not limited to audio, images, software, text, icons and such like (the “Content”), are protected by copyright under international conventions and intellectual property laws. You cannot use or license the Content, except as specified herein. You agree to follow all instructions on this Site limiting the way you may use the Content.
Products, services, and contents displaying on TripNight.com are the properties of this website. There are a number of proprietary logos, service marks and trademarks found on this Site whether owned/used by TripNight or otherwise. By displaying them on this Site, TripNight is not granting you any license to utilize those proprietary logos, service marks, or trademarks. Any unauthorized copy & use of the trademark product & services without prior concern will be taken as larceny and strict actions may be taken against the concern person/organization/company.
TripNight gives you a limited right to enter, explore, use and transact on its site. You agree not to misuse its materials and interrupt the operation of this Site in any way. You understand that except for information, products or services supplied by TripNight do not endorse any other information in any way. You also understand that TripNight does not assure that files available for downloading through the site will be free from any type of viruses.
While you may make limited copies of your travel itinerary (and related documents) for travel or service reservations booked through this Website, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through this Website.
9. Site and Content on the Site
This Site is only for your personal use. You shall not copy, license, adapt, distribute, exchange, modify, sell or transmit any content or material from this Site, including but not limited to any text, images, audio, video or links for any business, commercial or public purpose.

You acknowledge that TripNight is a conciliator, which is not accountable for any 3rd party obligations due to rates, quality, and all other instances. It is your duty to assess the exactness, comprehensiveness, and expediency of all advice, opinions, services, merchandise and other information provided on the site. We don’t assure that the service will be uninterrupted or error-free.

TripNight and its third-party suppliers, licensors, and partners do not guarantee or make any representations about the use or the results of the use of the services, the site or any reference sites in terms of correctness, accuracy, reliability, or otherwise.
You acknowledge that uninterrupted access or use of this website can be prevented by certain factors that are not in control including, unavailability of products & services, inoperability or interruption of the Internet or other telecommunications services or certain technical work carried out on this Website. You hereby give up any and all claim that any use of such material violates any of your rights including moral rights, privacy rights, proprietary or other property rights, publicity rights, rights to credit for material or ideas, or any other right, including the right to approve the way TripNight uses such material.
Any material submitted to this Site may be adapted, broadcasted, changed, copied, disclosed, licensed, performed, posted, published, sold, transmitted or used by TripNight anywhere in the world, in any medium, forever.

If your booking or account shows signs of fraud, abuse, or suspicious activity, TripNight may cancel any travel or service reservations associated with your name, email address, or account, and close any associated TripNight accounts. In addition, TripNight may verify (i.e. pre-authorize) your credit card. If you have conducted any fraudulent activity, TripNight reserves the right to take any necessary legal action and you may be liable for monetary losses to TripNight, including litigation costs and damages. To contest the cancellation of a booking or freezing or closure of an account, please contact TripNight Customer Service.
TripNight reserves the right to undertake all necessary steps to ensure that the security, safety, and integrity of TripNight systems, as well as its client’s interests, are and remain, well-protected. Towards this end, TripNight may take various steps to verify and confirm the authenticity, enforceability, and validity of orders placed by you.
If TripNight, in its sole and exclusive discretion, concludes that the said transactions are not or do not reasonably appear to be, authentic, enforceable or valid, then TripNight may cancel the said orders at any time up before the scheduled time of departure of the relevant flight or before the expected date of visit to any property booked through TripNight.
TripNight may provide you with notices and communications by email, regular mail or postings on the Site or by any other reasonable means. Except as otherwise set forth herein, notice to TripNight must be sent by courier or registered mail to and Tripnight Tech Labs Private Limited having its registered office at Office No 7, II Floor, H 25, Sector 63, Noida, Uttar Pradesh, India (Pincode: 201307).
17. Hikes in Tariffs & Taxes
We inform you on a prior basis that after the finalization of the tour package rates, for any hike in entrance fees, fuel cost, guide charges, and other services, you can be charged as extra. If government revises some taxes on travel services, clients are liable to pay that extra amount.
The failure of TripNight to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by TripNight.
18. General Terms:
TripNight.com, as being a reputed and responsible travel agency, provides you with the best possible information about the hotels, airlines, transportation, and railways. However, it is advised to all the clients to make a personal inquiry to avoid any confusion & mess.
We are not responsible for any delay & alteration in your trip due to unavoidable circumstances, which can be anything.
We are not responsible for any damage, loss or injury made during enjoying the holiday packages provided by us. You are accountable for your own safety measures.
We are also not accountable for any human error that gone unnoticed by the clients and our staffs.
19. Credit Policy for Travel Agents
If any travel agent avails services from the company using credit from the company and fails to clear the credit in certain days, TripNight.com can take legal action against him. In such cases, they are charged some interest rates that can be decided by the company itself. Firm lawful steps can be taken, if any cheating is found by the travel agent.
20. Governing Law and Forum for Disputes
Except as otherwise agreed by the parties or as described in the Arbitration section above, you agree that any claim or dispute you may have against TripNight must be resolved by a court located in New Delhi, India. You agree to submit to the personal jurisdiction of the courts located within New Delhi, India for the purpose of litigating all such claims or disputes. This Agreement shall be governed by the laws of India, without giving effect to any principles of conflicts of law.
21. Grievance Policy
TripNight strongly believes in a sincere and transparent approach to its users. You trust and love us and we would never put growth before trust. This policy document aims at minimizing instances of customer complaints, grievances and disappointments via channelized approach, review and redressal.
You can file a grievance/share feedback if you are disappointed with the services rendered by TripNight or any other issues. You can give your grievance/feedback through email or snail mail. In order to make TripNight redressal channels more meaningful and effective, a structured system has been put in place. This system will ensure that the complaints are redressed seamlessly and well within the stipulated time frame.
